Cultoni.com Public Offering Agreement
This public offering agreement is entered into between the seller located at CULTONI.COM and any interested party in accordance with the terms and conditions set forth in this agreement.
This contract is addressed to an indefinite number of persons.
1. GENERAL PROVISIONS
1.1. The seller sells goods through the online store at the address CULTONI.COM
1.2. By ordering goods through the online store, the user agrees to the terms of sale of goods posted on the CULTONI.COM website
1.3. The current conditions of sale of goods, as well as information about goods posted on the website, is a public offer in accordance with Art. 633 of the Civil Code of Ukraine.
1.4. The current conditions can be changed by the seller unilaterally without notifying the user / buyer. The new version of the terms of this agreement shall enter into force from the moment of its publication on the website, unless otherwise stipulated by the agreement itself.
1.5. The contract enters into force from the moment the seller sends the electronic confirmation of order acceptance to the buyer when the buyer places an order on the site CULTONI.COM
1.6. By informing the seller of his phone number, the user / buyer gives his consent to the use of the specified means of communication by the seller, as well as by third parties involved in the fulfillment of obligations to the user / buyer. The data is used for the purpose of distributing promotions, news about discounts, promotions, as well as other actions of the seller, about the transfer of the order for delivery, as well as other information directly related to the fulfillment of obligations to the buyer within the framework of this public offer. By placing an order, the user / buyer agrees that the seller can entrust the execution of the contract to a third party, while remaining responsible for its execution.
2. SUBJECT OF THE AGREEMENT
2.1. The subject of the contract is the opportunity given to the user to purchase for personal needs the goods presented in the catalog of the online store at the address CULTONI.COM
3. GOODS AND PURCHASE PROCEDURE
3.1. The seller ensures that he has the goods presented on the website.
the photos that accompany the product are just illustrations of it and may differ from the actual appearance of the product. Descriptions and specifications accompanying the product do not claim to be exhaustive and may contain typographical errors. To clarify information about the product, the Buyer can contact the customer support service.
3.2. In the event that the goods ordered by the buyer are not available from the seller, the latter has the right to exclude the specified goods from the order / cancel the order, notifying the buyer about this by sending an appropriate electronic message or by phone.
3.3. The buyer bears full responsibility for providing inaccurate information, which made it impossible for the seller to fulfill his obligations to the buyer.
3.4. In the absence of a fully or partially pre-paid order, the buyer is offered a replacement.
3.5. The buyer's order is placed online, through the shopping cart.
3.6. The maximum term of order processing and collection is 5 working days.
4. ORDER DELIVERY
4.1. The method, as well as the approximate terms of delivery of goods, are indicated on the site CULTONI.COM in the "Shipping and payment" section.
4.2. Delivery of orders is carried out on the territory of Ukraine. The delivery cost of each order is calculated independently by the carrier "Nova Poshta", based on the weight of the product, the region and the method of delivery. The buyer can calculate the delivery independently on the official website of "Nova Poshta" https://novaposhta.ua/
4.3. The dispatch of orders, if the goods are in stock, is carried out within 5 days from the moment of receipt of funds on the current account. During delivery, the order is handed over to the buyer or a third party specified in the order as the buyer or recipient. If the buyer is unable to receive the order, the order can be delivered to a person who can provide accurate information about the order. During the delivery of the order, the carrier "Nova Poshta" has the right to demand the presentation of a document certifying the recipient's identity.
4.4. The parcel is delivered to the warehouse of the carrier "Nova Poshta" indicated by the buyer. To receive the parcel, you need to present your passport and declaration number.
4.5. The risk of accidental destruction or accidental damage to the goods passes to the buyer from the moment the order is handed over to the carrier.
5. PRICE AND PAYMENT OF THE ORDER
5.1. The price of the product is indicated in hryvnias and includes all taxes provided for by law.
5.2. The price of the product is indicated on the website. In the case of an incorrect indication of the price of the ordered product, the seller informs the buyer about this in order to confirm the Order at the adjusted price or cancel the order.
5.3. The price of the product on the website can be changed unilaterally by the seller. At the same time, the price of the goods ordered by the buyer cannot be changed.
5.4. Payment for the goods is made by the buyer:
5.4.1. In cash at the time of receiving the order (in the amount that corresponds to the value of the order specified on the site CULTONI.COM , taking into account discounts if available) on the terms of payment by cash on delivery through the carrier "Nova Poshta" (payment is made after receiving the goods at the warehouse of the carrier "Nova Poshta").
5.4.2. By online transfer on the website, in hryvnias, during order placement (in the amount that corresponds to the cost of the order specified on the website CULTONI.COM , taking into account discounts if available).
5.5. The seller has the right to provide discounts on goods and establish a bonus program. The types of discounts, bonuses, the order and terms of their accrual can be changed by the seller unilaterally.
5.6. The commission of the carrier "Nova Poshta" for the delivery of money from the buyer to the seller is paid additionally by the buyer.
6. EXCHANGE AND RETURN OF GOODS
6.1 The product is returned in accordance with the return conditions specified on the site CULTONI.COM on the Return and Exchange page
6.2 The buyer has the right to refuse the received goods and terminate the sales contract in accordance with the Law of Ukraine "On the Protection of Consumer Rights" within 14 calendar days.
6.3 The buyer or seller has the right to terminate this contract at any time before the buyer accepts the goods.
6.4 must be accompanied by a self-filled application for the return of the given product with the reason for the return. Shipping of goods is carried out at the expense of the buyer.
6.5 Return of good quality goods:
6.5.1 The return of goods of appropriate quality is possible within 14 calendar days from the moment of receipt, provided that the goods have not been used, and the following have been preserved: their appearance, consumer properties, attached labels, shortcuts, labels and tags, as well as when availability of factory packaging. It is not allowed to apply inscriptions, addresses, etc. on the packaging.
6.6 Return of goods of inadequate quality:
6.6.1 A product of inadequate quality means a product that cannot ensure the performance of its functional qualities. Differences in design elements, color or design from those stated in the description on the website CULTONI.COM is not a sign of inadequate product quality and/or impossibility of its intended use.
6.6.2 After receiving the order, claims regarding external defects of the product, its quantity, completeness and product appearance are not accepted.
6.6.3 If the buyer received a product of inadequate quality, the buyer has the right to demand the return of the money paid in accordance with the Law of Ukraine "On the Protection of Consumer Rights".
6.6.4 The seller is not responsible for the defects of the goods that arose after their transfer to the buyer due to the buyer's violation of the rules for using or storing the goods, actions of third parties or force majeure.
6.6.5 If the reason for the return was an error by the seller, the buyer will be refunded the full cost of the order. Also, the seller of the online store pays for the return shipping of the product. The error of the seller / online store employee means: sending another model; shipment of a different size; inconsistency in the color of the photo model. At the same time, the inconsistency of the shade of the same color is not taken into account, due to the fact that the same image can look different on different monitors.
7. DURATION OF THE PUBLIC CONTRACT
7.1. A valid public offer enters into force from the moment of its acceptance by the user / buyer and is valid until the moment of withdrawal of acceptance of the public offer.
